The white tips on the tail feathers of the bird in your first picture would indicate a female (or young male) Ruby-throated Hummingbird. Most migrating birds should be in adult plumage so if it's a birds that recently appeared, there's a good chance it's an adult female.
The second picture appears to be of a male Ruby-throated. The tail appears to be of an adult, notched and lacking white tips. The gorget looks a little rough which indicate a bird still molting in its gorget. The gorget appears dark instead of red due to the angle of the light.
